ZUFFA WINS ‘ULTIMATE FIGHTING’
TRADEMARK CASE IN INDIANA DISTRICT COURT

Las Vegas, January 24, 2002… Zuffa LLC, the owner of the Ultimate Fighting Championship, today announced it won a legal victory yesterday (Jan.23) when the United States Seventh District Court for the Northern District of Indiana in Hammond, Ind., issued an order permanently barring Ultimate Athlete, a mixed martial arts media company based in Fresno, Calif., from infringing or causing confusion with Zuffa’s "Ultimate Fighting" and "Ultimate Fighting Championship" trademarks.
The court order stated Ultimate Athlete’s misuse of "Ultimate Fighting" and "Ultimate Athlete Fighting" in its promotions created public confusion over whether Ultimate Athlete was affiliated with the Ultimate Fighting Championship. Ultimate Athlete also agreed to refrain from encouraging third parties to misuse Zuffa’s trademarks.
"The popularity of mixed martial arts is really growing not only in the U.S., but also worldwide. It is unfortunate that we had to take this legal action against a group like Ultimate Athlete because its management was determined to infringe on our valuable brand names and trademarks. Hopefully, it is now understood that we have to protect our business and fortunately, the federal court system has allowed us to uphold our rights," said Dana F. White, president of the Ultimate Fighting Championship.
The Ultimate Fighting Championship is the leading mixed martial arts organization in the world. It is owned and operated by Zuffa LLC, which is headquartered in Las Vegas, Nev.
