Report: Nick Diaz’s Attempt to Overturn NSAC Suspension Denied by Nevada Court

Nick Diaz will still have to wait until February 4th to apply for a new license with the Nevada State Athletic Commission, as the fighter’s bid to have his one year suspension and $79,500 fine overturned in court has reportedly failed.

Diaz’s representatives attempted to argue in court that the year long suspension he was handed by the NSAC, after testing positive for marijuana following a fight with Carlos Condit in February, violated his rights. According to report from MMA Junkie, however, a Nevada judge has thrown out the case.

Diaz holds a medical prescription for marijuana in the state of California, which he uses to treat attention-deficit hyperactivity disorder. The fighter has tested positive for marijuana use twice after competing in Nevada.

The 29 year-old fighter returned to the UFC last October, and after handing BJ Penn a unanimous decision defeat at UFC 137, was handed a UD loss by Condit at UFC 143.

The UFC is working on signing a bout between welterweight champion Georges St. Pierre and Diaz for March 16th in Montreal.
