Report: Nick Diaz Suing NSAC to Have Suspension Lifted

Despite retiring from the fighting following his unanimous decision loss to Carlos Condit in February, Nick Diaz and his representatives have taken steps which would indicate that the welterweight’s days of competing aren’t over after all.

According to a report from MMA Fighting, Diaz has informed the Nevada State Athletic Commission that he is suing the organization for implementing a temporary suspension that he believes is unlawful.

After his aforementioned defeat to Condit, Diaz tested positive for marijuana metabolites and was subsequently suspended by the NSAC.

Amongst the arguments put forth by Diaz and his camp are the contention that his due process rights have been violated and that marijuana metabolite isn’t a prohibited substance under NSAC regulations.

The suit also states that Diaz is an “authorized medical marijuana patient”.

Attempts to reach the NSAC for a comment in the aforementioned report were unsuccessful.

In a UFC teleconference yesterday, Diaz’s younger brother Nate stated that he did not believe the fighter had changed his mind regarding retirement.
